3. Nature of our Services We provide B2B marketing diagnostics, analytics guidance, and advertising-related consulting services. Certain tools and diagnostics are offered free of charge as an entry-level service. All analysis, diagnostics, recommendations and interactions are performed exclusively by real human experts — no bots, no automated decision-making systems, no unsupervised AI are used in our core service delivery.

4. Eligibility You must be a business or professional acting in a B2B context to use our Services. Our Services are not intended for consumers (B2C) or individuals acting outside their professional activity.

5. User obligations You agree to:

  • Provide accurate, current and complete information when submitting requests or forms
  • Use the Site and Services only for lawful purposes
  • Not attempt to reverse-engineer, copy, scrape, or misuse our content, diagnostics methodology or outputs
  • Not use the Services to transmit spam, malware, or unlawful content

6. Intellectual property All content on the Site (text, graphics, tools descriptions, diagnostic frameworks, reports templates, etc.) is owned by Xiangweiads or its licensors and protected by copyright, trademark and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to view and use the Site and free diagnostics outputs strictly for your internal business purposes. You may not redistribute, resell, publish or commercially exploit any diagnostic reports, analyses or recommendations without our prior written consent.

7. Free diagnostics – no warranty Free diagnostics and guidance are provided “as is” and “as available”. They are general in nature, based on the information you provide, and do not constitute professional marketing, financial, legal or business advice. We do not guarantee any specific results, revenue increase, ROI or business outcome from following our diagnostics or recommendations.

8. Limitation of liability To the fullest extent permitted by law:

  • Xiangweiads shall not be liable for any indirect, incidental, consequential, special or punitive damages (including loss of profits, data, goodwill or business opportunities) arising from your use of the Site or Services
  • Our total liability shall in no event exceed €100 (one hundred euros)

9. No automated decision-making In line with our human-only policy and GDPR Article 22, no decisions producing legal effects or similarly significant effects on you are based solely on automated processing.

10. Indemnification You agree to indemnify and hold Xiangweiads harmless from any claim, loss, liability, damage or expense arising from your breach of these Terms or misuse of the Services.

11. Termination We may suspend or terminate your access to the Site or Services at any time, without notice, if we believe you have violated these Terms or applicable law.

13. Governing law and jurisdiction These Terms are governed by the laws of France. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Besançon, France.
